1. Acceptance of Terms

By using Hooky ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. You must be at least 18 years of age to use Hooky.

2. Description of Service

Hooky provides AI-powered phone call services including workplace absence notifications and entertainment prank calls. All calls are placed on behalf of the user who purchases the service. Hooky is a convenience tool — we are not an employment agency, staffing service, or employment advisor.

3. User Responsibilities

You are solely responsible for your decision to miss work and for how you use this service. By using Hooky, you acknowledge and agree that:

• You are at least 18 years old.
• You are solely responsible for your decision to be absent from work.
• Missing work may result in disciplinary action, termination, loss of benefits, or other employment consequences.
• You have reviewed and understand your employer's absence and attendance policies before using this service.
• You will not use Hooky for any unlawful purpose.

For prank calls: prank calls are for entertainment purposes only. You must have consent or a reasonable expectation that prank calls are welcome in your relationship with the target. Do not use this service to harass, intimidate, or harm others.

4. Assumption of Risk

You acknowledge and accept all risks associated with using this service, including but not limited to:

• Employer consequences such as disciplinary action, suspension, or termination.
• Loss of wages, benefits, or professional standing.
• The call not going as expected or the employer not accepting the absence notification.
• Any consequences arising from the content or outcome of any call placed on your behalf.

Hooky makes the call — you make the decision to miss work. That decision and its consequences are yours alone.

5. Payments & Refunds

All purchases are final. Refunds may be issued at our discretion if a call fails to connect due to a technical error on our end.

6. Prohibited Uses

You may not use Hooky to:

• Impersonate emergency services, government agencies, or financial institutions with intent to defraud.
• Harass, threaten, or intimidate any individual.
• Avoid legally mandated work obligations (e.g., court-ordered community service).
• Make false medical claims where prohibited by applicable law.
• Engage in any activity that violates local, state, or federal law.

7. No Employment, Legal, or Medical Advice

Hooky does not provide legal, medical, or employment advice. We are not qualified to advise you on your rights or obligations as an employee. We strongly recommend consulting your employer's attendance policies and, if needed, a qualified professional before using this service. Hooky does not guarantee that your employer will accept any absence notification placed on your behalf.

8. Indemnification

You agree to indemnify, defend, and hold harmless Hooky and its owners, operators, affiliates, and agents from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or any consequences resulting from calls placed on your behalf.

9. Limitation of Liability

Hooky is not liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the service, including but not limited to loss of employment, income, benefits, reputation, or business opportunities. The service is provided "as is" without warranties of any kind, express or implied.

In no event shall Hooky's total liability exceed the amount you paid for the specific service that gave rise to the claim.

10. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
